Leasing as a foreign investor

Foreign nationals cannot hold freehold title (Hak Milik) to land in Indonesia. A long-term lease is the common, lawful way for overseas investors to secure land for a villa.

The lease is drawn up and signed before a notary, and records the term, the extension option and the payment.

If you plan to build and rent out a villa, you will usually also need a local company (PT PMA) and a building approval (PBG). Ask your notary or legal adviser which structure suits your plans.
